Terms of Service.

Welcome to Testley. These Terms of Service ("Terms") govern your use of the Testley mobile application and website (collectively, the "Platform") operated by Pointcircle Labs Private Limited ("Testley," "we," "us," or "our").

By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use Testley.

1. Eligibility

Testley is designed for students in classes 8 through 12 preparing for JEE, NEET, and similar competitive examinations.

If you are under 18 years of age: By registering on Testley, it is deemed that your parent or legal guardian has reviewed and agreed to these Terms of Service and our Privacy Policy on your behalf. Your parent or guardian is responsible for your use of the Platform.

You may not use Testley if you have been previously suspended or removed from the Platform.

2. Account registration

To use Testley, you must create an account using your phone number (via OTP) or Google Sign-In. You agree to:

• Provide accurate and complete information during registration
• Keep your account credentials secure
• Not share your account with others
• Not create multiple accounts
• Notify us immediately if you suspect unauthorised access to your account

You are responsible for all activity that occurs under your account.

3. Services

Testley provides an adaptive practice platform with the following modes:

• Practice Mode: AI-powered adaptive questions that adjust to your skill level
• Build Mode: Create custom question sets by selecting subjects, chapters, and topics
• Mock Test Mode: Timed, exam-format tests simulating JEE/NEET conditions

Additional features include progress analytics, improvement opportunities, streaks, XP tracking, and AI-generated explanations.

4. Subscription plans and pricing

4.1 Free tier

Access to limited features including a capped number of questions per day and mock tests per week.

4.2 Pro Trial

New users receive a one-time 7-day free trial of Pro features. The trial cannot be restarted or extended. After the trial period, your account automatically reverts to the Free tier unless you subscribe.

4.3 Pro Plans

• Pro Monthly: ₹399 per month
• Pro Annual: ₹2,499 per year

Prices are inclusive of applicable taxes. We reserve the right to change pricing with reasonable notice to existing subscribers.

4.4 Payment

Payments are processed securely through Razorpay. By making a purchase, you agree to Razorpay's terms of service. We do not store your payment card or banking details.

4.5 Auto-renewal

If auto-renewal is enabled, your subscription will automatically renew at the end of each billing period. You can disable auto-renewal at any time through the app. If auto-renewal is disabled, your Pro access continues until the end of the current paid period.

5. Refund policy

• Free trial: No charge is made during the trial period. No refund applicable.
• Paid subscriptions: All subscription payments are non-refundable once processed. You may cancel auto-renewal at any time, and your Pro access will continue until the end of the current billing period.
• Technical errors: If a payment was successfully processed but Pro features were not activated due to a technical error on our part, you may contact us at support@testley.com within 7 days of the payment for a full refund.
• Refund processing: Approved refunds are processed through Razorpay and may take 5-7 business days to reflect in your account.

6. AI-generated content

Testley uses artificial intelligence to generate explanations for questions. While we strive for accuracy:

• AI-generated explanations are provided for learning assistance only
• They may occasionally contain errors or inaccuracies
• They should not be treated as a substitute for textbooks, coaching materials, or expert guidance
• We recommend cross-referencing AI explanations with authoritative sources

Testley is not liable for any academic outcome based on reliance on AI-generated content.

7. Previous year questions

Testley may include questions from previous years' JEE, NEET, and other competitive examinations. These questions are sourced from publicly available exam papers. Testley is not affiliated with, endorsed by, or associated with the National Testing Agency (NTA), Central Board of Secondary Education (CBSE), or any examination conducting body.

8. Intellectual property

All content on the Platform — including questions, explanations, design, code, graphics, and branding — is owned by or licensed to Pointcircle Labs Private Limited and is protected by Indian copyright and intellectual property laws.

You may not:

• Copy, reproduce, or distribute any content from the Platform
• Reverse engineer, decompile, or disassemble any part of the Platform
• Use automated tools (bots, scrapers) to access or extract content
• Share your screen recordings of questions or explanations publicly

Your session data (responses, scores, progress) belongs to you and can be deleted at any time via account deletion.

9. Acceptable use

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorised access to our systems or other users' accounts
• Interfere with or disrupt the Platform's infrastructure
• Impersonate any person or entity
• Upload malicious code or content
• Exploit the referral program through fake accounts or fraudulent activity
• Circumvent free tier limits through technical manipulation
• Share or sell your account access to others

10. Account deletion

You may delete your account at any time through:

• In-app: Profile → Settings → Delete Account
• Web: testley.com/delete-account
• Email: support@testley.com

Upon deletion, all your personal data and usage history will be permanently removed from our systems in accordance with our Privacy Policy. This action is irreversible.

11. Limitation of liability

To the maximum extent permitted by law:

• Testley is provided on an "as is" and "as available" basis
• We do not guarantee uninterrupted or error-free service
• We are not responsible for any loss of data due to technical failures beyond our reasonable control
• Our total liability to you for any claim arising from your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim
• We are not liable for any indirect, incidental, consequential, or punitive damages

12. Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the Platform or other users

Upon termination by us for a violation, you will not be entitled to a refund of any subscription fees. We may also terminate or modify the Platform at any time with reasonable notice.

13. Changes to these terms

We may update these Terms from time to time. When we make significant changes:

• We will update the "Last Updated" date
• We will notify you through the app or via email for material changes

Your continued use of Testley after changes constitutes acceptance of the updated Terms.

14. Governing law and dispute resolution

These Terms are governed by the laws of India. Any disputes arising from or related to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.
